What WITNESS is

WITNESS is an evidence-backed creator intelligence service. It observes the platforms you connect, reconciles what they report, explains what changed, and — only where you have explicitly authorized it — executes actions on your behalf and records their outcome. WITNESS is not a certainty machine: when evidence is insufficient it reports UNKNOWN rather than guessing, and it keeps source evidence, WITNESS analysis, and model output visibly distinct. It is not financial, legal, or professional advice.

Eligibility and accounts

You must be at least 18 years old and able to form a binding contract to use the Service. You are responsible for keeping your sign-in method secure and for all activity under your account. If you use WITNESS on behalf of an organization, you represent that you have authority to bind that organization, and “you” includes it.

Connected platforms and authorization

• You may connect third-party platforms (for example TikTok, Spotify, Apple Music, YouTube, UnitedMasters, or a performing rights organization). You may only connect accounts you own or are authorized to manage.
• Each platform’s own terms continue to apply to you and to the data it provides. For TikTok, this includes the TikTok Terms of Service and Community Guidelines; WITNESS’s use of TikTok data is further bound by the TikTok Developer Terms of Service.
• WITNESS acts only within the scopes you grant and only for as long as the authorization is valid. WITNESS never signs in as you, never escalates its own permissions, and never takes an irreversible or spending action without your explicit approval for that action.
• If you choose to hold a browser session with WITNESS, you authorize WITNESS to use that session to read your own data from the provider on the schedule shown to you, and you acknowledge that some providers’ terms discourage automated access. You may revoke a held session at any time.
• You can disconnect any platform at any time from Connections. Disconnecting deletes the stored credential and stops further observation.

Your content and data

You own the content you upload and the data your connected platforms provide about your work. You grant WITNESS a limited, non-exclusive licence to store, process, and display that content and data solely to provide the Service to you. WITNESS does not sell your data, does not use it for advertising, and does not use it to train machine-learning models. Findings, explanations, and records WITNESS produces for you are yours to keep and export.

Acceptable use

You agree not to: connect accounts you do not control; use the Service to collect data about other people; attempt to circumvent access limits, rate limits, or platform authorization; probe, scan, or test the vulnerability of the Service without written permission; reverse engineer the Service except where the law allows; resell the Service without our agreement; or use the Service in violation of any law or any connected platform’s terms. We may suspend or terminate accounts that violate these terms.

Plans, payment, and cancellation

Some features require a paid plan. Prices are shown before you purchase. Subscriptions renew automatically until cancelled; you may cancel at any time from Settings, and cancellation takes effect at the end of the current billing period. Payments are processed by our payment processor under its own terms. Except where required by law, fees are non-refundable. We may change prices with at least 30 days’ notice.

API and developer use

If we issue you API credentials, you must keep them confidential, use them only for your own workspace, respect the documented limits, and not misrepresent WITNESS output as source truth. We may change or deprecate API features with reasonable notice.

Intellectual property

The Service, including its software, design, documentation, and the WITNESS name and mark, is owned by WITNESS or its licensors and is protected by intellectual-property law. These terms do not grant you any right to use the WITNESS name or mark. Feedback you send us may be used without obligation to you.

Availability and changes

We work to keep the Service available and honest about its state — the public health endpoint reports what WITNESS can and cannot currently verify. Nevertheless the Service is provided on an “as available” basis; we may change, suspend, or discontinue features, and we will give reasonable notice of material changes where practical.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WITNESS REPORTS WHAT THE EVIDENCE SUPPORTS; PLATFORM DATA MAY BE DELAYED, ROUNDED, RESTATED, OR WRONG AT THE SOURCE, AND WITNESS DOES NOT WARRANT THAT ANY FIGURE, FINDING, OR RECOMMENDATION IS ACCURATE OR THAT ANY ACTION WILL PRODUCE A PARTICULAR RESULT. YOU REMAIN RESPONSIBLE FOR DECISIONS YOU MAKE.

Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WITNESS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR ONE HUNDRED US DOLLARS. Some jurisdictions do not allow these limitations, in which case they apply to the maximum extent permitted.

Indemnity

You will defend and indemnify WITNESS against claims arising from your content, your connected accounts, your violation of these terms, or your violation of a connected platform’s terms or of applicable law.

Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you materially breach these terms, if required by law, or if a connected platform requires it. On termination your right to use the Service ends; your data is handled as described in the Privacy Policy, and Sections 8, 10, 11, 12, and 14 survive.

Governing law and disputes

These terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Denton County, Texas, and you consent to their jurisdiction, except that either party may seek injunctive relief in any court of competent jurisdiction. If any provision of these terms is unenforceable, the rest remains in effect.

Changes to these terms

We may update these terms. We will change the effective date above and, for material changes, notify you inside the Service or by email at least 14 days before they take effect. Continued use after that date is acceptance of the updated terms.
